Federal Reporting Requirements on Payments to Physicians: Impact on State Laws

With the enactment of the Patient Protection and Affordable Care Act in March 2010, all U.S. manufacturers of drugs, devices, biologics or medical supplies covered under government-funded insurance programs (i.e., Medicare, Medicaid and the State Children's Health Insurance Program) are now required to report certain information to the federal Department of Health and Human Services (HHS) about any payment or gift, which are “transfers of value,” made to a physician or teaching hospital. HHS is required to make these data available to the public by posting them on a Web site.
