Texas Courts Can Improve Processes for Debt Collection Lawsuits
Pew comments highlight opportunities to increase fairness, effectiveness of state rules
On March 4, 2022, The Pew Charitable Trusts submitted comments to the Clerk of the Supreme Court of Texas on proposed amendments to the Texas Rules of Civil Procedure regarding seizure of personal property to satisfy a debt collection judgment. The comments highlighted strategies that would make it easier for people with debt-related judgments against them to protect themselves from property seizures, improve the process for notifying defendants that they are being sued as well as the clarity of those notices, and measure the effectiveness of the amended rules.
